1. Introduction

By accessing and using the Hunger Ride App, Users agree to be bound by the terms and conditions set forth herein. This Agreement governs the relationship between the Company and Users, outlining the rights and obligations of each party concerning the use of the App and the services provided therein.

2. Definitions

This Agreement defines certain terms used throughout these Terms and Conditions.

• "App" refers to the Hunger Ride mobile application.
• "User" refers to any individual or entity using the Hunger Ride App.
• "Company" refers to Hunger Ride.
• "Services" refers to the services provided through the Hunger Ride App.

3. Description of Service

Hunger Ride operates as a technology platform connecting Users with merchants for the delivery of goods.

4. User Eligibility

Users must be at least 18 years old and possess the legal capacity to enter into this Agreement.

5. User Accounts

Users must create an account to access certain features of the App and agree to provide accurate, current, and complete information during the account creation process.

6. User Conduct

Users agree to use the App in compliance with all applicable laws and regulations.

7. Payment

Users agree to pay for services rendered through the App, including delivery fees and any applicable taxes.

8. User Responsibilities

Users are responsible for providing accurate and up-to-date information when requesting services.

9. Background Checks

The Company reserves the right to conduct background checks on drivers and merchants using the platform.

10. Intellectual Property

All intellectual property rights related to the App and its content belong to the Company.

11. Ratings and Reviews

Users may rate and review drivers and merchants based on their experiences.

12. Insurance

Drivers and merchants agree to maintain appropriate insurance coverage.

13. Limitation of Liability

The Company shall not be liable for any damages arising out of the use of the App.

14. Indemnification

Users agree to indemnify the Company from all claims arising from their use of the App.

15. Dispute Resolution

Disputes shall be resolved by arbitration in accordance with the rules of the American Arbitration Association.

16. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the State of Connecticut, United States.

17. Amendments

The Company may amend these Terms at any time by posting a revised version on the App.

18. Severability

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in effect.

19. Entire Agreement

This Agreement constitutes the entire agreement between the parties concerning the subject matter herein.

20. Waiver

No waiver of any term of this Agreement shall be deemed further or continuing waiver of such term or any other term.

21. Background Check and Authorization

I, the undersigned, acknowledge, understand, and authorize HUNGERIDE LLC and its authorized agents or background screening providers, including but not limited to Checkr, Certn, ClearChecks, or any consumer reporting agency (CRA), to obtain and use one or more consumer reports and/or investigative consumer reports about me in accordance with the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., for purposes of determining my eligibility to operate as a contractor, independent driver, or service provider on the HUNGERIDE platform.

I understand that the reports may include, but are not limited to: criminal history from federal, state, county, and tribal court systems; sex offender registry checks pursuant to 42 U.S.C. § 16911 et seq.; national and international watchlist searches (OFAC, FBI Most Wanted, Interpol, Global Sanctions); Social Security Number verification and address trace; motor vehicle reports (MVR) in accordance with the Driver Privacy Protection Act (DPPA), 18 U.S.C. § 2721; driving license validation, history of suspensions, traffic violations, DUI/DWI, points, and restrictions; employment verification and job performance checks under FCRA § 604(b)(2); education and academic credential validation; credit history (only if applicable and job-related, under FCRA § 604(g)); civil litigation records, liens, bankruptcies, and judgments; professional license verification and disciplinary history; drug and alcohol screening (if applicable), under 49 CFR Part 40; and social media screening (limited to publicly available information and only as permitted by applicable law).

I understand that HUNGERIDE LLC will provide me with a “Summary of My Rights Under the Fair Credit Reporting Act,” as required under FCRA § 609(c), and that I will have the right to receive a copy of the consumer report upon request, be informed if the information in the report was used to make an adverse decision, dispute inaccurate or incomplete information with the CRA, and file a complaint with the Consumer Financial Protection Bureau (CFPB) if my rights are violated.

I acknowledge that HUNGERIDE LLC will comply with FCRA § 604(b)(3) by providing me with a pre-adverse action notice and the opportunity to dispute the results before any final decision is made.

I further acknowledge that the Company will comply with all applicable federal, state, and municipal laws, including but not limited to: Ban the Box laws (e.g., California AB 1008, NYC Fair Chance Act); Equal Employment Opportunity Commission (EEOC) Enforcement Guidance on the Use of Arrest and Conviction Records (No. 915.002, April 25, 2012); state-specific privacy regulations such as the California Consumer Privacy Act (CCPA), Colorado Privacy Act, and Illinois Personal Information Protection Act (PIPA); and the Federal Trade Commission’s Disposal Rule (16 CFR Part 682) regarding secure handling and destruction of sensitive personal information.

I authorize HUNGERIDE LLC to obtain updated consumer reports periodically during the course of my engagement, in accordance with FCRA § 604(a) and all applicable state regulations. I also understand that refusing to authorize this background check may result in ineligibility to be engaged on the platform.

I affirm that I am providing this authorization voluntarily, and that all information submitted to HUNGERIDE LLC is true and correct. I acknowledge and agree that by clicking the checkbox labeled “I Agree”, I am electronically signing this document, and that such signature is legally valid and enforceable under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.

This authorization shall remain valid for the duration of my engagement with HUNGERIDE LLC and may be revoked at any time by providing written notice to the Company.
